Please read these terms carefully before using SECUTER’s security monitoring and automation services.
These Terms and Conditions (“Terms”) govern your use of security monitoring, video surveillance, smart home automation, and related services (“Services”) provided by SECUTER (“we,” “us,” or “our”). By subscribing to or using our Services, you (“Customer,” “you”) agree to be bound by these Terms.
1. Service Agreement
1.1 Service Description
SECUTER provides professional security monitoring, video surveillance, smart home automation, and related services for residential and commercial properties. Services include but are not limited to:
- 24/7 professional alarm monitoring with emergency dispatch
- Video surveillance with AI-powered detection and recording
- Smart home automation (locks, lights, thermostats, and other connected devices)
- Mobile app access for system control and notifications
- Access control management for commercial customers
1.2 Service Plans
SECUTER offers the following monthly service plans, subject to change with 30 days’ notice:
- Signal: $43.99/month – Basic 24/7 monitoring and supervised security
- Access: $51.99/month – Interactive security with remote control and smart arming
- View: $55.99/month – Security with video surveillance and analytics
- Link: $55.99/month – Security with smart home automation
- Connect: $63.99/month – Complete security, video, and automation
SECUTER does not require long-term contracts. All plans are billed month-to-month and may be cancelled at any time without penalty or early termination fees.
1.3 Service Activation
Services begin upon completion of professional installation and system activation by a SECUTER certified technician. You are responsible for providing accurate contact information, emergency contacts, and property access for installation and service.
1.4 Customer Responsibilities
As a SECUTER customer, you agree to:
- Maintain accurate account information and emergency contacts
- Test your system periodically as recommended by your technician
- Report any equipment malfunctions or damage promptly
- Ensure the system has adequate power and communication connectivity
- Provide access for scheduled maintenance and service visits
- Use the system in compliance with all applicable local, state, and federal laws
2. Monitoring Services
2.1 Professional Monitoring
SECUTER provides 24/7 professional monitoring through UL-listed monitoring centers. When an alarm signal is received, our monitoring operators will attempt to verify the alarm and dispatch appropriate emergency services in accordance with established protocols and local regulations.
2.2 Emergency Dispatch
You authorize SECUTER and its monitoring partners to contact emergency services (police, fire, medical) on your behalf when an alarm event requires dispatch. You acknowledge that:
- Response times of emergency services are outside SECUTER’s control
- Some jurisdictions require alarm permits and may impose fines for false alarms
- You are responsible for obtaining any required alarm permits in your jurisdiction
- You are responsible for any false alarm fines imposed by local authorities
2.3 Limitations of Monitoring
While SECUTER strives to provide reliable monitoring services, you acknowledge that no security system can prevent all emergencies or guarantee detection of every event. Factors that may affect system performance include but are not limited to: communication network outages, power failures exceeding battery backup capacity, severe weather conditions, and equipment malfunction.
3. Equipment
3.1 Equipment Options
SECUTER offers flexible equipment arrangements:
- Purchase: You own the equipment outright. Equipment is yours to keep if you cancel service.
- Lease: Equipment remains the property of SECUTER and must be returned in good condition upon service cancellation.
3.2 Installation
Professional installation is performed by SECUTER certified technicians. You grant SECUTER permission to install equipment at the designated property, including mounting devices, running wiring, and making reasonable modifications necessary for proper installation. SECUTER will use commercially reasonable efforts to minimize any cosmetic impact.
3.3 Equipment Warranty
SECUTER-provided equipment is covered by a limited manufacturer warranty. During the warranty period, defective equipment will be repaired or replaced at no cost. Damage caused by misuse, unauthorized modification, acts of nature, or power surges is not covered under warranty.
3.4 Maintenance
SECUTER provides remote system health monitoring and automatic firmware updates. On-site service visits for equipment issues are available. You are responsible for replacing batteries in wireless sensors and maintaining a clean, unobstructed environment for sensors and cameras.
4. Cancellation
4.1 No Contract, Cancel Anytime
SECUTER does not impose long-term contracts. You may cancel your monitoring service at any time by calling 1-855-SECUTER or contacting support through the mobile app. There are no early termination fees, cancellation penalties, or buyout charges.
4.2 Cancellation Process
- Cancellation requests are processed within 5 business days
- Monitoring service ends at the conclusion of the current billing period
- No refunds are issued for partial billing periods
- Leased equipment must be returned within 30 days of cancellation
- Purchased equipment remains your property
4.3 Service Suspension
SECUTER reserves the right to suspend or terminate services if:
- Payment is more than 30 days past due
- The system is used for any illegal purpose
- The customer interferes with or tampers with equipment
- Continued service poses a safety risk to SECUTER personnel
5. Limitation of Liability
5.1 Service Limitations
You acknowledge and agree that SECUTER’s security systems are designed to reduce risk but cannot eliminate it. No alarm system, monitoring service, or security measure can guarantee prevention of burglary, fire, personal injury, or property damage.
5.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECUTER’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SECUTER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
5.3 Exclusions
SECUTER is not responsible for:
- Losses or damages caused by communication network failures, power outages, or force majeure events
- Response times of emergency services or their failure to respond
- Losses resulting from customer failure to maintain the system or provide accurate contact information
- Damage caused by unauthorized modification of equipment
- Third-party service interruptions affecting system connectivity
5.4 Insurance
SECUTER’s services are not a substitute for insurance. We strongly recommend that all customers maintain appropriate homeowner’s, renter’s, or business insurance coverage.
6. Governing Law
6.1 Applicable Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
6.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.
6.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
6.4 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
6.5 Entire Agreement
These Terms, together with the Privacy Policy and any service-specific agreements, constitute the entire agreement between you and SECUTER regarding the Services.
6.6 Modifications
SECUTER reserves the right to modify these Terms at any time. Material changes will be communicated via email or through the mobile app at least 30 days before taking effect. Continued use of Services after the effective date constitutes acceptance of the modified Terms.
